Terms and Conditions
Proudly providing you services for sport events, we hereby provide you the agreements which apply to the use of the website www.martial.events. We divided our agreements into two sections; one between the user and Martial.Events ("Platform Agreement"), and one between the user and the organisation of the event: ("Ticket Agreement"). Below you will read details of each agreement. Exclusive Dutch law applies to both agreements.
This Platform Agreement is provided by Martial.Events ("Martial.Events"), located at Mozartplantsoen 50, 3363 LM Sliedrecht, The Netherlands and registered with the Chamber of Commerce under number 69687706. If you use the Platform, you enter into an agreement with Martial.Events (the "Platform Agreement") as "User".
The articles under the heading "Ticket Agreement" are not applicable to Martial.Events. Martial.Events reserves the right to alter this Platform Agreement. By using the Martial.Events Platform you agree to the terms and conditions of the most recent version.Platform Service
Through its online digital platform (the "Platform"), Martial.Events offers a service that allows users to promote, buy and sell e-tickets for sport events (the "Platform Service"). Any registered entry is considered a ticket or e-ticket. You can use the Platform Service by registering an account. All personal data should be filled in truthfully. Additionally when promoting events and selling e-tickets through the Platform, Martial.Events will grant access to every new user manually. Using the Platform to promote events and sell tickets, you additionally act as "Organiser".Privacy
Martial.Events offers this Platform and its content as presented on the screen ('as is'). It is subject to change without prior notice. Although the content of this website has been compiled with the greatest possible care, Martial.Events will offer no guarantees with regard to the nature or content of the information, services and products provided on this website. Furthermore, Martial.Events will offer no guarantee that the information, services and products on this website do not infringe any intellectual property rights held by third parties. Neither can Martial.Events guarantee the uninterrupted proper functioning of the website. Except in the case of deliberate intent or gross negligence on the part of Martial.Events, Martial.Events explicitly rejects all liability for damage or loss that can be attributed directly or indirectly to the access to and consultation or use of the information, data and publications on the website and/or the access to and use.Abuse
As a condition for the use of the Platform Service, you agree not to offer any information, data or content through the Platform that may infringe any law or regulation.
Furthermore, you agree that you:
- will not feign an improper relationship with a person or entity;
- will not access restricted/protected areas of the Platform;
- will not forward any viruses, worms, junk mail, spam, chain letters, unsolicited offers or advertisements of any kind and for any purpose; and
- will not check, scan or test the vulnerability of the Platform or any other related system or network, or act in breach of any security or authentication
If Martial.Events suspects that you do not comply with the Platform Agreement, Martial.Events may (permanently) deny you access to the Platform and to the Platform Service with immediate effect.Disclosure of information
Martial.Events reserves the right at all times to disclose any information that Martial.Events deems necessary to comply with any applicable law, regulation, legal process or governmental request.Complaints procedure
Martial.Events puts it values into a high customer service. If you have any complaint about services Martial.Events provides, Martial.Events would like to be informed thereof. Please send your full complaint (as complete as possible) to email@example.com.
If you buy tickets and/or sell tickets you enter into this agreement. The specific legal entity, with whom you enter into this Ticket Agreement, depends on the place of the event of the ticket concerned. Martial.Events reserves the right to alter this Ticket Agreement. If you offer for sale or purchase an e-ticket, you automatically consent to the most recent version of this Ticket Agreement.Purchase agreement:
Between the "Seller" and "Buyer" of a ticket a Purchase Agreement is included.Selling tickets
As Organiser (Seller) you can offer tickets for sale through the platform. Martial.Events' support may be requested by Organiser, but Organiser will remain responsible for all contents related to their event.E-ticket / ticket
Any registered entry is considered a ticket, which requires full payment of User and possible approvals by Organiser(s). Seller reserves the right to put any form of limitations on selling, such as a limit to the number of Tickets that can be purchased.Cost and Price
Seller himself determines the selling price of each e-ticket that he offers on the Platform (the "Sales Price"). For every e-ticket for which a purchase agreement is concluded, Seller owes an amount equal to 3.5% + 0.50 EUR of the Sales Price (excl. VAT) ("Service Fees") to Martial.Events. Payment of this amount will take place by way of offsetting. Seller shall thus receive the Sales Price minus the Service Fee.VAT
Martial.Events is not responsible for any payment of account of VAT or other taxes on the face value of any tickets sold through the platform. This is the responsibility of Seller. Martial.Events charges VAT to Seller over the Service Fee, if subjected to VAT or other taxes.Payment to Seller
After the registration deadline, and not earlier than one (1) week before the event is taking place, Seller reserves the right to receive the agreed Sales Price minus the Service Fees (the "Payment"). It is the Seller's responsibility to provide valid and up-to-date payment details to Martial.Events. Martial.Events will not be responsible or held liable if payment is made to an incorrect account provided by Seller. Any change in payment details must be made in good times before the Payment is scheduled.
Any outstanding or unpaid invoices to Martial.Events may result in Payments not being transferred to Seller and/or the subsequent amount owed being deducted from the total due to be transferred. After a notification of (suspected) fraud, the Payment to Seller may be suspended until more clarity about the situation exists. If, according to Martial.Events, there is reason to do so, the Payment by Martial.Events may be cancelled.Chargebacks
Martial.Events has the interest in providing good services, having good relationships and works together with its payment service provider to prevent chargebacks. If anyhow a chargeback results against Martial.Events by an event of Seller, Seller will be liable and will indemnify Martial.Events against any losses that result from the case. If a chargeback is made occurring Martial.Events, Martial.Events will raise an invoice to Seller for the associated fees.Cancellation:
Once purchased, tickets cannot be transferred, exchanged, refunded or returned unless the event is cancelled or postponed. Martial.Events must be informed by Organiser in writing, in reasonable time before the event, when the event is intended to be cancelled or postponed. Martial.Events reserves the right to charge Organiser an administrative fee of 50.00 EUR plus a 0.50 EUR fee per transaction (excl. VAT) as result of cancelling an event. Refunds will cover the face value of the ticket only and will only be issued if no Payment is transferred yet to Seller. If a Payment is already transferred to Seller, it becomes the responsibility of Seller to provide refunds.Intellectual Property
Organiser will remain owner of the copyright of any original material that is provided to the Platform. By providing this material Organiser irrevocably and unconditionally grant Martial.Events a non-exclusive, worldwide, royaltee-free license. This includes the right for Martial.Events to sub-license the entire rights, title and interest in such uploaded material so that Martial.Events and any heir or successor may, subject to these terms, use the material in any way, including the right to copy, edit, adapt, reformat, translate, create derivative works from, without limitation and to incorporate it into other work, distribute, perform, play, broadcast, use for commercial purposes and otherwise make it available to the public, either in whole or in part, or by copies, in any format or medium known now or which may be developed in the future, for the full period during which such rights subsist.Buying tickets
The Buyer of an e-ticket can pay online through the offered payment methods. The e-ticket Sales Price is set by Seller and includes VAT. Upon purchase, a final agreement between the Seller and the Buyer has been concluded.
Prices are liable to change at any time. These changes will not affect orders already placed. There may be a restriction on the maximum number of tickets that may be purchased per person, per debit/credit card or per setting (such as categories). Martial.Events and Seller will do their best to make this clear on the Platform, but reserve the right to cancel, without notice, any orders that exceed the authorised maximum.
The Platform contains a large quantity of tickets and events and as such, there is always the possibility that despite best efforts, tickets may be incorrectly priced. As part of Martial.Events approval process, price is usually verified, however when an error has been made, Martial.Events and Seller reserve the right to cancel or reject your order and will notify you of such action. You will then be able to reorder at the correct price.Liability

You agree not to supply any information, data or content through the Platform that infringe any law or regulation. Furthermore, you agree that you:
- will not feign an improper relationship with a person or entity;
- will not access restricted/protected areas of the Platform;
- will not send any viruses, worms, junk mail, spam, chain letters, unsolicited offers or advertisements of any kind and for any purpose; and
- will not check, scan or test the vulnerability of the Platform or any other related system or network, or act in breach of any security or authentication.
If Martial.Events suspects that you do not comply with the Platform Agreement, Martial.Events may (permanently) deny you access to the Platform and to the Platformservice with immediate effect.Cancellation
Once purchased, tickets cannot be transferred, exchanged, refunded or returned unless the event is cancelled or postponed. Organiser and/or Martial.Events will do their best to inform Buyer using the contact details provided. It can however not be guaranteed that contact with Buyer can be made.
If an event has been cancelled or postponed, subject to availability, Buyer will be offered tickets to the rescheduled event up to the face value previously paid, or if Buyer is unable to attend the rescheduled event, or the event is cancelled, a refund will be issued. Refund requests should be sent to firstname.lastname@example.org within 14 days of the cancelled event. Requests made after this time will not be accepted. Refunds will be issued to the original purchaser or back onto the credit or debit card used in the original transaction.
If the venue or third party supplier requires to reduce an allocation or if Seller has oversold an event due to human error, Martial.Events and Seller reserve the right to cancel tickets. In this case, Buyer will be provided with a full refund.Force Majeure
Martial.Events will not be responsible for any failure or delay of the Platform or Platform Service provided due to occurrences commonly known as Force Majeure.
Force Majeure includes but is not limited to, embargoes, strikes, riots, war, terrorism or threats of terrorism, attacks, lock-outs, civil commotion, or other concerted acts of workmen, causalities or accidents, or any other causes or circumstances beyond Martial.Event's control that prevent or thwart the performance provided by us and any of its obligations hereunder.
Force Majeure includes but is not limited to, fire, explosion, earthquake, storm, flood, epidemic or other natural disaster, as well as the impossibility of use of public or private transport, the use of motor transport, shipping or aviation and the impossibility of the use of public or private telecommunication networks.
For the entire period that Force Majeure continues, our performance under all terms will be deemed suspended. During that period, we will have an extension of time for the performance of our Platform and Platform Service. We will use reasonable efforts to bring the Force Majeure event to a close or find a solution to which our obligations under these Terms may be performed despite the Force Majeure.
